1: The RENTER shall keep and maintain the rented trailer during the terms of the rental period at the customer's own cost and expense. Customer shall keep the trailer in a good state of repair during the rental period.

2: The RENTER shall pay Tow-N-Go Trailer Rentals full compensation for full replacement of any trailer which is not returned because it is lost or stolen and/or repair costs including parts & labor, of any trailer which is damaged and in need of repair to put it into the same condition it was in at the time of rental.

3: The RENTER shall inform Tow-N-Go Trailer Rentals, upon demand, of the exact location of the trailer at any time while it is in the RENTER’s possession. Trailers are not to be taken outside the State of Texas without prior WRITTEN consent from Tow-n-Go Trailer Rentals (the “Owner”).

4: Rental charges are billed to the RENTER for the full term, even if the trailer is returned before the end of the term. If the trailer is not returned during or at the end of the term, then the rental charges shall continue on a full-term basis for any additional term until the trailer is returned.

5: If the RENTER is in default of any of the terms and conditions of this agreement, Tow-N-Go Trailer Rentals, at the RENTER’s risk, cost, and expense, may at any time enter the RENTER’s premises where the rented trailer is stored or used at all time and recover the rented trailer.

6: The RENTER agrees not to pledge, lien, or otherwise encumber the rented trailer under any circumstances. Should the RENTER fail to make timely rental payments or file for creditor protection in any legally recognized jurisdiction, the OWNER reserves the right to recover and take possession of the trailer immediately.

8: Tow-N-Go Trailer Rentals provides no warranties of any kind for the rented trailer. However, if the trailer fails to function according to the manufacturer’s specifications and operating instructions, Tow-N-Go Trailer Rentals will replace it with an identical or similar trailer. Tow-N-Go Trailer Rental Safety Protection Plans are available.

9: The RENTER agrees to indemnify and hold Tow-N-Go Trailer Rentals harmless from any injuries or damages arising from repossession, as well as from any consequential or special damages related to any alleged breach of warranty.

10: The RENTER shall be responsible for all reasonable attorney fees, expenses, and costs incurred by Tow-N-Go Trailer Rentals in protecting its rights under this rental agreement, including any actions taken to recover amounts owed to Tow-N-Go Trailer Rentals.

11: Tire damage or blowouts due to road hazards (nails, screws, potholes, curbs etc..) are the RENTER's responsibility and must be reported IMMEDIATLY to Tow-n-Go Trailer Rentals 24hr roadside service.Tow-N-Go Trailer Rental Safety Protection Plans are available.

These terms are accepted by the RENTER upon delivery of the terms to the RENTER.
